Discuss, consider and/or take action to exempt from competition, per LGC 262.024(3), an item necessary because of unforeseen damage to public property with MH Civil Constructors for the sewer screen project for Facilities Maintenance.

Comment:

The amount of fabric being deposited into the sewer at detention is beyond what anyone anticipated.  The sewer screen that was installed in not designed to handle fabric and they need to add a grinder before the screen.  Right now, the detention crew cleans out the screen 2-3 times a week so the screen can go back to functioning.  If everything was running as originally anticipated, maintenance crew should not have to clean the screen/screw conveyor other than during a normal PM process on a quarterly basis.  The clog ups are also causing damage to the new equipment and shortening the lifespan of the equipment. 

Additionally, if any other contractor works on the current equipment/controls for the sewer screen before the warranty period is up, it will void the construction warranty with MH Civil.
